Know Your Rights: Worker Protections Under the Law

As an American worker, you have important legal rights that protect your ability to organize and advocate for better working conditions.


The National Labor Relations Board (NLRB)


The NLRB protects your right to:

  • Join or form a union
  • Bargain collectively with your employer
  • Discuss wages and working conditions with coworkers
  • Take action to improve working conditions
  • Choose not to participate in union activities

  • Protection from Retaliation


    It is ILLEGAL for your employer to:

  • Fire you for union activity
  • Threaten you for supporting a union
  • Promise benefits to discourage union support
  • Spy on union meetings
  • Question you about union activities

  • What to Do If Your Rights Are Violated


    If you believe your rights have been violated:

    1. Document the incident in detail

    2. Report to the National Labor Relations Board (NLRB)

    3. Contact a union organizer or labor attorney

    4. File a formal complaint (Unfair Labor Practice charge)


    Workers Not Covered by NLRB


    Some workers have different protections:

  • Federal employees (covered by other laws)
  • Agricultural workers (varies by state)
  • Domestic workers (varies by state)
  • Independent contractors (not covered)

  • State Laws May Provide Additional Protections


    Many states have laws that provide additional worker protections. Check your state's labor department for specific information.
